Terms of Use

These Terms of Use govern access to and use of the Project FR platform, websites, applications, fundraising pages, dashboards, and related services.

1. Acceptance of these terms

By accessing or using Project FR, you agree to be bound by these Terms of Use and any policies or guidelines incorporated by reference. If you do not agree, do not use the platform.

2. Platform purpose

Project FR is a school fundraising platform designed to support school-branded fundraising operations, campaign administration, athlete outreach workflows, supporter donation flows, and related finance and reporting functions.

3. Eligibility and authority

You may use Project FR only if you are authorized to do so and are legally capable of entering into these Terms. If you use Project FR on behalf of a school, organization, or other entity, you represent and warrant that you have authority to bind that entity to these Terms.

4. Accounts and credentials

Users are responsible for maintaining the confidentiality of account credentials and for all activity that occurs under their accounts. You agree to provide accurate information, keep account information current, and notify Project FR promptly of any unauthorized access or suspected security incident.

Project FR may suspend or disable accounts that pose security, legal, operational, or abuse-related risk.

5. School responsibilities

Schools and authorized school personnel are responsible for how they configure and use Project FR, including campaign setup, staff and athlete access, branding choices, outreach workflows, fundraising operations, compliance obligations, and the accuracy of information entered into the platform.

Schools are also responsible for determining whether their use of Project FR complies with applicable district, school, student, fundraising, communications, privacy, and payment requirements.

6. Payments and connected accounts

Project FR may facilitate donation flows through third-party payment providers, including Stripe. Donations made through the platform may be processed through a school’s connected payment account in accordance with the school’s configuration and applicable payment provider requirements.

Project FR is not responsible for payment processor availability, bank processing times, chargebacks, card network decisions, or third-party payment service interruptions.

7. Messaging and communications

Project FR may provide communication and outreach features, including SMS-related workflows. Users are responsible for using those tools lawfully and only with appropriate authority and consent, where required.

Users may not use Project FR messaging features for spam, harassment, deceptive communications, unlawful solicitations, or any activity that violates carrier rules, messaging provider rules, or applicable law.

8. Acceptable use

You agree not to:

  • use the platform for unlawful, fraudulent, or deceptive purposes
  • misrepresent a school, campaign, user, or donation purpose
  • attempt to gain unauthorized access to data, systems, or accounts
  • interfere with platform security, integrity, or availability
  • upload malicious code or exploit platform vulnerabilities
  • use the platform in a way that infringes privacy, intellectual property, or other legal rights

9. Content and data

Users retain responsibility for the information, content, contact data, campaign details, branding materials, and other materials they submit to or manage through Project FR.

You grant Project FR the rights reasonably necessary to host, process, transmit, display, and use such information to operate and improve the platform and to provide the requested services.

10. Service changes and availability

Project FR may update, modify, suspend, or discontinue features or functionality from time to time. We do not guarantee uninterrupted availability or that the platform will be error-free at all times.

11. Intellectual property

Project FR and its related software, design, visual elements, text, functionality, and branding are protected by applicable intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, reverse engineer, or create derivative works based on the platform.

12. Third-party services

Project FR may rely on third-party services and integrations, including payment, hosting, file storage, messaging, analytics, and authentication providers. Project FR is not responsible for the acts, omissions, policies, or availability of third-party services.

13. Disclaimer of warranties

To the maximum extent permitted by law, Project FR is provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

14. Limitation of liability

To the maximum extent permitted by law, Project FR and its affiliates, operators, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or business opportunity arising out of or related to use of the platform.

To the maximum extent permitted by law, the total liability of Project FR for any claim arising out of or relating to the platform or these Terms will not exceed the greater of the amount paid to Project FR for the applicable services in the twelve months before the claim arose or one hundred U.S. dollars.

15. Indemnification

You agree to defend, indemnify, and hold harmless Project FR and its affiliates, operators, and service providers from and against claims, losses, liabilities, damages, costs, and expenses arising from your use of the platform, your content or data, your violation of these Terms, or your violation of applicable law or third-party rights.

16. Termination

Project FR may suspend or terminate access to the platform at any time, with or without notice, if necessary to protect the platform, users, schools, service providers, or legal compliance interests.

Provisions that by their nature should survive termination will survive, including provisions relating to ownership, disclaimers, limitations of liability, indemnification, and dispute-related terms.

17. Governing law

These Terms will be governed by and construed in accordance with the laws of the applicable governing jurisdiction designated by Project FR, without regard to conflict of law principles.

Before public launch, replace this section with your finalized governing law and venue language.

18. Changes to these terms

We may update these Terms from time to time. When we do, we may revise the effective date above and post the updated version on this page. Continued use of the platform after changes become effective constitutes acceptance of the updated Terms, to the extent permitted by law.
